General Awareness Updates – December 2013

The Delhi High Court declined to grant stay on ongoing inquiry proceedings by a committee set up by the Badminton Association of India (BAI) against ace shuttler Jwala Gutta (right) for alleged indiscipline. Ms Gutta approached the high court challenging the show cause notice issued to her by the committee on 14th October and also sought a stay on its proceedings against her.

Justice V. K. Jain referred to his 10th October order and said no interim order is required as the court has already granted relief to her by asking BAI to allow her to participate in the national and international tournament. Allowing the committee to go ahead with its proceedings, Justice Mr Jain said, “If she is aggrieved of any decision of the committee, she can approach this very court.”

The three-member disciplinary panel comprises Indian Olympic Association (IOA) joint secretary Anandeshwar Pandey, Luge Federation of India president Deepa Mehta and Swati Shukla, a former associate of the Commonwealth Games Organising committee.

The BAI's disciplinary committee had recommended a life ban on Ms Gutta for trying to stop some players of her franchise Delhi Smashers from playing a match against Banga Beats in the recent Indian Badminton League.

The controversy had erupted during the August 25 tie when Delhi Smashers threatened to pull out against Banga Beats over the last-minute replacement of injured singles player, Hu Yun of Hong Kong with Denmark's Jan Jorgensen.

In a setback to N. Srinivasan, (right) the President of the Board for Control of Cricket in India (BCCI), the Supreme Court proposed three-member panel headed by former Chief Justice of Punjab and Haryana High Court Mukul Mudgal to independently probe into IPL spot-fixing scandal. The Supreme Court rejected the BCCI's suggestion for setting up a special committee to probe the IPL spot-fixing scandal and proposed a three-member panel headed by former Punjab and Haryana Chief Justice Mukul Mudgal to examine the issue.

A bench of Justices A. K. Patnaik and J. S. Kehar also proposed the names of senior advocate and Additional Solicitor General N. Nagehswar Rao and Assam Cricket Association member Nilay Dutta to be part of the panel. It asked the counsels of BCCI and Cricket Association of Bihar (CAB), which are at loggerheads on the issue of fresh probe in the scandal, to seek instructions on the proposed panel and posted the case for hearing for tomorrow when a formal order would be passed on it.

The bench turned down BCCI's proposal for setting up a Special Purpose Committee (SPC) comprising senior politician Arun Jaitley and Nilay Dutta to look into the issue. It also turned down the plea of BCCI that the proposed panel should find out if further probe is required into all the issues mentioned in the charge sheet filed by the Mumbai Police in the scandal. The bench said that the panel would conduct an independent inquiry into the allegations and submit its report to the Supreme Court. “Mumbai Police can go on its own. Let the panel make an independent inquiry and give report to the Supreme Court and suggest remedial measures,” the bench said.

The court was hearing cross appeals filed by BCCI and CAB challenging Bombay High Court's order which had declared the BCCI's probe panel in the scandal as illegal. The apex court had on August 30 heard the petition filed by Aditya Verma, Secretary, CAB, challenging the high court's order refusing to appoint a fresh committee to probe the scam. The CAB has pleaded that when the high court declared the panel of two judges as unconstitutional, it should have appointed a fresh committee to look into the issue.
